Terms of service

Last updated on 24 September 2026. The Dutch version prevails. Virenix's company details are at the bottom of every page.

Who we are and what these terms cover

Virenix provides hosting services, including game servers. Our company details (name, address, Chamber of Commerce and VAT number) are shown at the bottom of every page of this website. These terms apply to every order, account and service from Virenix. Different arrangements only apply if we have agreed them with you in writing, which includes email. A customer's own terms do not apply.

Definitions

Customer: anyone who creates an account or uses a service. Consumer: a customer who is not acting for a trade or business. Service: anything you buy from us, such as a game server. Period: the term you pay for in advance, one month by default.

Your account

To order, you create an account with accurate and complete details. You keep your login details secret and are responsible for everything that happens through your account. If you suspect misuse, let us know straight away. You must be at least 16 years old. If you are under 18, you need permission from a parent or guardian.

Offer, prices and ordering

All prices on the website are in euros and exclude VAT. VAT is calculated when you order and shown on the invoice. Obvious errors in prices or specifications do not bind us. The agreement is formed once your order has been paid and we have confirmed it. We then set up your service as quickly as possible.

Right of withdrawal for consumers

As a consumer, you may cancel a distance contract within 14 days without giving a reason. Because a server is delivered right after payment, we ask you to explicitly agree to immediate delivery when you order. If you then withdraw within 14 days, you only pay for the part of the period the service was already available, and we refund the rest. You can withdraw with the withdrawal button in your dashboard, or by email. You receive a confirmation straight away.

Payment and renewal

You pay each period in advance using the payment methods offered at checkout. A service renews automatically for the same period unless you cancel it before the current period ends. We announce price changes at least 30 days in advance, and they only take effect from the next period. If you do not agree, you can cancel before the new price applies.

Late payment

If an invoice is not paid by its due date, we send a free reminder giving you another 14 days to pay. If payment still does not follow, we may suspend the service. We only end the service and delete the related data 14 days after suspension, and we warn you before we do. For consumers, the statutory rules on collection costs apply; business customers owe the statutory commercial interest from the due date.

Acceptable use

You use your service in a way that respects the law and the rights of others. In any case, you may not use it to spread malware, phishing or spam, to attack other systems (including DDoS attacks), to mine cryptocurrency, or for content that is illegal or infringes the rights of others, such as sharing pirated copies. You use shared hardware reasonably, so other customers are not affected. If you break this section, we may suspend or end the service immediately, without a refund.

Availability, maintenance and DDoS protection

We do our best to keep your service reachable at all times, but we do not guarantee uninterrupted availability. We announce planned maintenance in advance on the website or Discord, preferably outside peak playing hours. That is not always possible for outages or urgent maintenance. All services include DDoS protection. No protection stops every attack; during a very large attack we may temporarily limit traffic to protect our network and other customers.

Backups and your own data

In the control panel you can create and restore backups yourself, up to the number included in your plan. These backups are a safety net, not a replacement for your own copy, so keep your own copy of important data as well. Your data remains yours. When a service ends, we delete its data and backups, so export anything you want to keep before the period ends.

Cancellation and termination

You can cancel a service at any time in your dashboard. It stays active until the end of the paid period and is then not renewed. Cancelling does not refund a period you have already paid for, except when you withdraw as described above. We can end an agreement with 30 days' notice, for example when we discontinue a product. In that case we refund what you paid in advance for the remaining time.

Liability

Our liability is limited to direct damage, up to the amount you paid for the service concerned in the three months before the damage. We are not liable for indirect damage, such as lost income, lost game progress or loss of data you could have kept a copy of yourself. These limits do not apply in case of intent or deliberate recklessness by Virenix, and do not affect your statutory rights as a consumer.

Force majeure

We are not liable for failures caused by circumstances beyond our control, such as outages at the data centre or energy suppliers, large-scale internet outages, or attacks that succeed despite reasonable measures. If force majeure lasts longer than 30 days, either party may end the agreement, and we refund what you paid in advance for that time.

Changes to these terms

We may change these terms. We announce important changes by email at least 30 days in advance. If you do not agree with a change to your disadvantage, you can cancel before it takes effect.

Complaints, governing law and disputes

If you have a complaint, open a ticket or email us. We respond with a substantive answer within 14 days. These terms are governed by Dutch law. If we cannot resolve a dispute together, the court in the district where we are established has jurisdiction. As a consumer, you may also choose the court where you live.
